Terms of Service
These terms apply to every order placed on this site. They are written to be read rather than to be impenetrable, and where they limit something, they say so plainly.
Who you are dealing with
This site is operated by Zyphera TCG. Contact details and business information are on the Contact page.
By placing an order you confirm you are at least 18, or have the permission of a parent or guardian, and that the payment method is yours to use.
Orders and acceptance
- Placing an order is an offer to buy. A contract exists once we send you an order confirmation email.
- We may decline or cancel an order where a price or description was wrong, where stock is not available, where an allocation limit has been exceeded, or where we suspect fraud. If we do, you are refunded in full.
- Where we cancel, we tell you why. We do not cancel silently and let you find out from a refund appearing.
Prices and currency
- All prices are shown and charged in USD.
- Prices can change at any time, but the price of a confirmed order never changes after purchase, including on preorders.
- Import duty, VAT and customs handling fees on international orders are set by the destination country, are collected from you by the carrier or the customs authority, and are not included in the price you pay us. We never receive them.
- If your card is in another currency, your bank sets the conversion rate and may add a fee. That is between you and your bank.
Payment
We accept Visa, Mastercard, American Express, Apple Pay, Google Pay and Bank transfer.
Payment is taken in full at checkout, including on preorders. Card details are entered on our payment provider's own encrypted page; we never see or store them.
Preorders
Preorders are governed by the Preorder Policy, which forms part of these terms. In summary: you are charged at checkout rather than on release day, your price is locked, release dates are set by the publisher and may move, and you can cancel for a full refund at any point before dispatch.
Delivery
- Free tracked shipping on every order, worldwide, with no minimum spend.
- In-stock orders are dispatched within one business day. Preorders are dispatched on or shortly after the publisher's release date.
- Delivery estimates are the carrier's and are estimates, not guarantees. We are not liable for a delay caused by a carrier, a customs authority, or an event outside our reasonable control.
- Risk in the goods passes to you on delivery, not on dispatch. If a parcel is lost or damaged in transit, that is ours to resolve.
Returns
Unopened, factory-sealed product may be returned within 14 days of delivery. Damaged, faulty or incorrect items are returned at our cost. The Refund & Return Policy sets out the detail and forms part of these terms.
What we do not warrant
We warrant that products are genuine, sealed, and as described. We do not warrant what is inside a sealed product: pull rates are set by the manufacturer and are a matter of chance.
We make no representation about the future value of anything we sell. Trading card product is not an investment and we do not present it as one.
Limits of liability
Our liability for any order is limited to the amount you paid for it. We are not liable for indirect or consequential loss, including any loss of profit or of anticipated value.
Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.
Acceptable use
- Do not use automated tools to place orders, evade allocation limits, or scrape this site at a rate that degrades it for other people.
- Do not attempt to gain access to any part of this site you have not been granted access to.
- We may cancel orders and refuse future ones where these are breached.
Intellectual property
Product names, logos, set names and card images are the property of their respective publishers. We are an independent retailer and are not affiliated with, endorsed by or sponsored by The Pokémon Company, Nintendo, Konami, Wizards of the Coast, Hasbro or Bandai.
The text, layout and photography on this site are ours.
Changes to these terms
We may update these terms. The version that applies to your order is the version live when you placed it, and we do not apply changes retroactively.
Governing law
These terms are governed by the law of the country we trade from, and nothing in them removes any protection you have under the consumer law that applies where you live.
